Gebruiksvoorwaarden

1. Acceptatie van voorwaarden

Door toegang te krijgen tot of gebruik te maken van een applicatie of dienst van Mialos ("wij", "ons", "onze"), waaronder De Horeca Helper en Brickd, ga je akkoord met deze Gebruiksvoorwaarden. Als je niet akkoord gaat met deze voorwaarden, gebruik onze diensten dan niet.

2. Beschrijving van diensten

Mialos ontwikkelt en beheert mobiele en webapplicaties. Onze diensten worden geleverd "zoals ze zijn" en kunnen naar eigen inzicht worden gewijzigd, bijgewerkt of stopgezet zonder voorafgaande kennisgeving.

3. Gebruikersaccounts

Sommige van onze diensten vereisen dat je een account aanmaakt. Je bent verantwoordelijk voor:

• Het vertrouwelijk houden van je accountgegevens.
• Alle activiteiten die onder je account plaatsvinden.
• Het verstrekken van nauwkeurige en actuele informatie.

Wij behouden ons het recht voor om accounts op te schorten of te beëindigen die deze voorwaarden schenden.

4. Aanvaardbaar gebruik

Je gaat ermee akkoord om niet:

• Onze diensten te gebruiken voor onwettige doeleinden.
• Te proberen ongeautoriseerde toegang te krijgen tot onze systemen of accounts van andere gebruikers.
• De integriteit of prestaties van onze diensten te verstoren.
• Enig deel van onze diensten te reproduceren, dupliceren, kopiëren, verkopen of exploiteren zonder uitdrukkelijke schriftelijke toestemming.

5. Intellectueel eigendom

Alle inhoud, functies en functionaliteit van onze diensten — inclusief maar niet beperkt tot tekst, afbeeldingen, logo's en software — zijn eigendom van Mialos en worden beschermd door Nederlandse en internationale intellectuele eigendomswetten.

6. Beschikbaarheid

Wij streven ernaar onze diensten te allen tijde beschikbaar te houden, maar wij garanderen geen ononderbroken of foutloze toegang. Wij zijn niet aansprakelijk voor enige downtime, dataverlies of dienstonderbrekingen.

7. Beperking van aansprakelijkheid

Voor zover toegestaan door de toepasselijke wetgeving:

• Is Mialos niet aansprakelijk voor indirecte, incidentele, bijzondere, gevolg- of punitieve schade.
• Is Mialos niet aansprakelijk voor verlies van winst, gegevens, gebruik of goodwill als gevolg van het gebruik van onze diensten.
• Onze totale aansprakelijkheid voor enige claim met betrekking tot onze diensten bedraagt niet meer dan het bedrag dat je ons hebt betaald in de 12 maanden voorafgaand aan de claim.

8. Afwijzing van garanties

Onze diensten worden geleverd op een "zoals het is" en "zoals beschikbaar" basis, zonder enige garantie, expliciet of impliciet, inclusief maar niet beperkt tot impliciete garanties van verkoopbaarheid, geschiktheid voor een bepaald doel of niet-inbreuk.

9. Wijzigingen van voorwaarden

Wij behouden ons het recht voor om deze Gebruiksvoorwaarden op elk moment te wijzigen. Wij stellen gebruikers op de hoogte van wezenlijke wijzigingen via onze apps of per e-mail. Voortgezet gebruik van onze diensten na wijzigingen houdt acceptatie in van de herziene voorwaarden.

10. Beëindiging

Wij kunnen je toegang tot onze diensten onmiddellijk opschorten of beëindigen, zonder voorafgaande kennisgeving, om welke reden dan ook, inclusief schending van deze Voorwaarden. Bij beëindiging vervalt je recht om onze diensten te gebruiken onmiddellijk.

11. Toepasselijk recht

Deze Gebruiksvoorwaarden worden beheerst door en uitgelegd in overeenstemming met het Nederlandse recht. Eventuele geschillen die voortvloeien uit deze voorwaarden vallen onder de exclusieve jurisdictie van de rechtbanken in Nederland.

1. Acceptance of Terms

By accessing or using any application or service provided by Mialos ("we", "us", "our"), including but not limited to De Horeca Helper and Brickd, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

2. Description of Services

Mialos develops and operates mobile and web applications. Our services are provided "as is" and are subject to change, update, or discontinuation at our discretion without prior notice.

3. User Accounts

Some of our services require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and up-to-date information.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the integrity or performance of our services.

All content, features, and functionality of our services — including but not limited to text, graphics, logos, and software — are owned by Mialos and are protected by Dutch and international intellectual property laws.

6. Availability

We strive to keep our services available at all times, but we do not guarantee uninterrupted or error-free access. We are not liable for any downtime, data loss, or service interruptions.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• Mialos shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Mialos shall not be liable for any loss of profits, data, use, or goodwill arising from the use of our services.
• Our total liability for any claim related to our services shall not exceed the amount you have paid to us in the 12 months preceding the claim.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will notify users of material changes through our apps or via email. Continued use of our services after changes constitutes acceptance of the revised terms.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use our services ceases immediately.

11. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in the Netherlands.
